1. Acceptance of Terms

By accessing and using CyberStream's lead generation services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

CyberStream provides lead generation services through advanced social media automation and AI-powered targeting. Our services include:

• Prospect identification and qualification
• Automated outreach campaigns
• Social media marketing automation
• Performance analytics and reporting
• CRM integration services

3. Performance-Based Pricing

Our pricing model is performance-based, meaning you only pay for qualified leads that meet the criteria established in your service agreement. Pricing ranges from $40 to $60 per qualified lead, depending on the advertising channel and targeting complexity.

3.1 Qualified Lead Definition

A qualified lead is defined as a prospect who has:

• Responded positively to our outreach efforts
• Expressed genuine interest in your products or services
• Met the demographic and behavioral criteria specified in your campaign
• Provided valid contact information

3.2 Payment Terms

Invoices are generated monthly based on qualified leads delivered. Payment is due within 30 days of invoice date. Late payments may result in service suspension.

4. Client Responsibilities

Clients are responsible for:

• Providing accurate target audience criteria
• Responding to qualified leads in a timely manner
• Maintaining compliance with applicable laws and regulations
• Providing feedback on lead quality for optimization

5. Data Usage and Privacy

We collect and process data in accordance with our Privacy Policy. By using our services, you consent to the collection and use of information as outlined in our privacy policy.

6. Intellectual Property

All proprietary technology, algorithms, and methodologies used by CyberStream remain our intellectual property. Clients receive a limited license to use our services but do not acquire ownership rights to our technology.

7. Service Availability

While we strive for 99.9% uptime, we cannot guarantee uninterrupted service availability. Scheduled maintenance will be communicated in advance when possible.

8. Limitation of Liability

CyberStream's liability is limited to the amount paid for services in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate services with 30 days written notice. Upon termination, clients remain responsible for payment of all qualified leads delivered prior to termination.

10. Compliance and Legal Requirements

Clients must ensure their use of our services complies with:

• CAN-SPAM Act and similar anti-spam legislation
• GDPR and other data protection regulations
• Platform-specific terms of service for social media networks
• Industry-specific regulations applicable to their business

11. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be communicated via email and posted on our website. Continued use of services constitutes acceptance of modified terms.

12. Governing Law

These terms are governed by the laws of the State of Texas, United States. Any disputes will be resolved through binding arbitration in Midland, Texas.
